The State Duma Committee on Transport proposes to adopt in the second reading a bill on the transfer of inspection functions from the police to commercial entities. The third reading may take place on 15 June. According to the chairman of the State Duma Committee on Transport Sergei Shishkaryov, the bill may be considered at a meeting of the Federation Council on June 22. Russian President Dmitry Medvedev has repeatedly raised the issue of the need to restore order in this sphere, and instructed to prepare proposals to significantly simplify the inspection procedure or to cancel it completely by July 1, 2016. According to the new wording of the bill, the owner will not be able to conclude a contract of compulsory motor liability insurance without having to produce a voucher. This means that the actual inspection procedure will be transferred to the insurance companies. The vehicles, which do not exceed three years of age, will not undergo a technical inspection, 3-7-year-old vehicles (including trucks up to 3 tons) are to be inspected once every two years, and over seven years-annually. Every six months, they will be obliged to inspect taxis, buses, minibuses, annually-trucks more than 3 tons, special transport (police cars, ambulances). The bill establishes a two-year transitional period from the beginning of the law, if adopted, effective 1 January 2012. During this period, the owners will be able to apply to both the current centers for technical inspection and the newly created structures, and if necessary, lawmakers will be able to amend the law on the basis of its practice. Data on the passage of the ET are planned to be included in a special automated database, but in the initial stage the owners will have to get the usual voucher, which they will be required to present in the insurance company. In order for the price of the TVE to rise significantly, the bill leaves the Federal Service on Tariffs a right to set limit values. Each region will be able to regulate these tariffs only downwards. From the moment of the entry into force of the new law, the owners will not be tied to the region or to the municipal education during the passage of the TOS-the procedure can be held in any technical center of the country. Dealers will need to be accredited in the Russian Federation of Motor Insurers. The rules of accreditation will be developed by the Economic Development Ministry. The bill provides a mechanism for the protection of car owners from abuse in the conduct of the inspection procedure. In particular, the driver will be able to pick up the documents at any stage of the passage and go to another technical center if he sees that he is being forced to do some services. And yet it is to be hoped that the dealers will cherite their reputation, which means that they will not allow such situations. In addition, the legislators introduce the joint responsibility of the technical centres and the drivers for the failure of the car which caused the accident. If the insurance company is able to prove that the procedure was not followed or performed negligent and caused the accident, the technical center will be responsible for such violations.
