Young offenders on scooters-in jail
The law gives the Supreme Court of the Russian Federation.
Inertia privileges The statistics of accident victims do not allow us to be condescending to the drivers of scooters: several hundred assemblies have been lost in the country since the beginning of the motorcycle season. Many are convinced that the owners of the 50-box machines enjoy legal privileges. It works as an inertial thought: up to a certain point, they actually existed. -But, summer-out! The Criminal Code (art. 264) prescribes that if, as a result of a traffic violation by a person driving a car, a tram or other motor vehicle, people are injured, the perpetrator can be prosecuted and deprived of liberty for up to 7 years. But not the drivers of the scooters. This is the result of legal fiction. According to the text of the Regulation, the scooter does not fall within the definition of "motor vehicles". According to paragraph 1. 2. SDA, they do not include mopeds and other mechanisms on wheels with engine capacity less than 50 cm³ and developing maximum speeds of 50 km/h. That is, they are equated to a bicycle or a cart with a pair of mares. What's the driver's demand? Legal nonsense, but the law wasn't written for him. Seven years of imprisonment, however, since 2008, the drivers of the scooters who violated the rules and caused other harm to health, by resolution of the Supreme Court of the Russian Federation, are criminally responsible under article 268 of the Criminal Code of the Russian Federation. The person will be deprived of liberty for up to five years or imprisonment for a term of up to seven years, depending on the severity of the consequences. Do you want to do the vest, too? You will recall that very often school-age students are on the scooter, and the age supposedly protects them from prosecution. We're gonna have to disappoint. The Criminal Code provides for the criminal liability of persons who have reached the age of 16 (remember that only when that age is reached and allowed to sit on the scooter). If the offender is young, you can't punish him? Maltz is not to be held criminally responsible-it is for parents to take a duvout: they will have to pay damages. Remember, this is not about a small scratch on the hood (though, despite the car's hood), we're looking at the cases of the affected people. You're not getting away with it. Here's a dilemma: if anyone saw that the boy was "on the edge", to say, "where do we go"? Or wait for the trouble to happen? And parents need to think a hundred times before you put a child on a scooter. The car accident just happened, was a teenager.
